European Case Law

On 16 June 2026, Law No. 120/2026, commonly known as the “Ferragni Decree”, was published. The law introduces specific rules governing commercial initiatives linked to charitable purposes.

The new legislation seeks to ensure greater transparency for consumers when products or services are promoted by referring to donations, fundraising activities or other charitable initiatives. Its purpose is to enable consumers to understand clearly the relationship between the purchase of a product and the benefit actually allocated to the stated charitable purpose.

Companies intending to carry out campaigns of this kind must therefore pay particular attention to the information provided to consumers. They must clearly specify the beneficiary, the purpose of the initiative, its duration and the method used to determine the amount allocated to the charitable cause.

The law also introduces mandatory notifications to the Italian Competition Authority, both before the launch of the initiative and after its conclusion, so that compliance with the obligations undertaken by the business in favour of the charitable organisations can be verified.

The new provisions form part of a broader trend towards increased scrutiny of the fairness and transparency of commercial communications. Claims, promotional materials and digital content should therefore be carefully reviewed to ensure that the information provided to consumers is complete, accurate and consistent with the actual characteristics of the initiative being promoted.
